These Terms of Service ("Terms") govern your access to and use of the validibot.com website ("Website") operated by McQuillen Interactive Pty. Ltd. (ABN 49 600 623 069) ("McQuillen Interactive", "we", or "us"). By accessing or browsing the Website, you confirm that you accept these Terms. If you are using the Website on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

Scope: These Terms apply to your use of the validibot.com website only. If you purchase a Validibot Pro or Enterprise subscription (whether self-hosted or cloud), your use of the software or hosted service is governed by the applicable Commercial License Agreement together with the Acceptable Use Policy, the Data Processing Addendum, and our Privacy Policy. Those documents together constitute the complete agreement for paid products and supersede these Website Terms with respect to the software and service. If you use the Validibot Community Edition, your use is governed by the AGPL-3.0 license.

1. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to create an account or purchase services through the Website.

2. Account Security

If you create an account on the Website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share your account credentials with others. Notify us immediately at support@validibot.com if you suspect unauthorised access to your account.

3. Acceptable Use

You agree to use the Website lawfully and responsibly. You must not:

  • Interfere with the operation of the Website or attempt to gain unauthorised access to any systems or networks;
  • Upload malicious code, viruses, or harmful content;
  • Scrape, crawl, or use automated tools to extract content from the Website beyond what is permitted by robots.txt;
  • Violate any applicable laws or regulations.

4. Intellectual Property

The Website content, including all software, designs, text, graphics, logos, and other content, is owned by McQuillen Interactive or our licensors and is protected by copyright, trademark, and other intellectual property laws. "Validibot", the Validibot logo, and the Validibot robot character are trademarks of McQuillen Interactive Pty. Ltd.

Information on the Website about building energy models, data validation, and related technical topics is provided for general informational purposes only. It does not constitute professional engineering, architectural, or compliance advice. You remain solely responsible for verifying information and making decisions based on it.

6. Disclaimer of Warranties

The Website is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure.

7. Limitation of Liability

To the maximum extent permitted by law, McQuillen Interactive is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the Website. Our total aggregate liability for all claims arising from or related to the Website shall not exceed AUD $100.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded by agreement. Where the Australian Consumer Law permits us to limit our liability, our liability is limited at our option to resupplying the relevant services or refunding any amounts you paid for the relevant service period.

The Website may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third-party sites. Your use of third-party sites is at your own risk.
